provides that a committal proceeding commences on the commencement of a filing hearing. This is different from the commencement of a criminal proceeding. Clause 5 indicates how a criminal proceeding is commenced. Clause 6(4) provides that the informant may include a request for a committal proceeding on the charge-sheet (when the criminal proceeding commences). Clause 10(2) indicates that a proceeding for an indictable offence that may be heard and determined summarily may be listed for a filing hearing, having regard to any request for a filing hearing from the informant. However, an indictable offence that cannot be heard and determined summarily must be listed for a filing hearing. Clause 102 provides for the fixing of a date for a filing hearing.
