Clause 162

provides that the filing of an indictment other than a direct indictment does not commence a new criminal proceeding against the accused. The Bill operates on the basis that, where an accused is committed for trial on a charge and the indictment includes a charge for that offence or a related offence, there is one proceeding with different stages of committal and trial.
