Clause 159

states that, subject to the Public Prosecutions Act 1994, the DPP or a Crown Prosecutor in the name of the DPP may file an indictment. Subclause (2) allows an indictment to be filed at any time, except where otherwise provided by or under this Bill or any other Act. Subclause (3) requires an indictment to be in writing, to be signed by the DPP or a Crown Prosecutor in the name of the DPP, and to comply with Schedule 1.
