provides that the filing of a direct indictment commences a criminal proceeding. Direct indictment is defined in clause 3 and the ways in which a criminal proceeding can be commenced are provided for in clause 5. Clause 3 provides that a direct indictment is an indictment for a charge where the accused was not committed for trial in relation to that charge or a related charge. In the vast majority of cases, however, the charges on the indictment are the same or are related charges to charges on which the accused was committed for trial. In that situation, the indictment does not commence a criminal proceeding. The most common example of a direct indictment arises where the DPP decides to file an indictment for a charge where the Magistrates' Court discharged the accused at the committal proceeding.
