provides for the procedure following the non-appearance of an accused who has been served with a notice to appear. It distinguishes between a summary offence and an indictable offence that may be heard and determined summarily, in the same way as clauses 80 and 81 (in relation to non-appearance on a summons). For summary offences, the court may issue a warrant to arrest the accused, adjourn the proceeding on any terms or proceed to hear and determine the case in the absence of the accused in accordance with Division 10 of Part 3.3. For indictable offences that may be heard and determined summarily, the court may only issue a warrant to arrest the accused.
