Clause 5
sets out that a criminal proceeding is commenced in one of three ways—
by filing or signing a charge-sheet in accordance with the procedure set out in clause 6;
by filing a direct indictment in accordance with clause 159 (which sets out that the DPP or a Crown Prosecutor may file an indictment); or
by a direction under clause 362 that a person be tried for perjury.
