Clause 195

applies to cases where the indictment contains a charge of conspiracy to commit an offence and another charge alleging the commission of that offence. In such cases, the court is required to order that the charge of conspiracy be tried separately from the other charge, unless it considers that it would be in the interests of justice to try the charges together. The clause applies despite clause 193 and displaces the presumption in clause 170 that if an indictment contains more than one charge, the charges must be heard together.
