Clause 158

provides that this Chapter applies if an accused is committed for trial under Chapter 4 or a direct indictment is filed against an accused. Clause 3 defines direct indictment. Unless expressly provided for, or necessarily implied, the powers in this Chapter are available from the point of committal for trial or the filing of a direct indictment, as the case may be.
