Clause 340

sets out the requirements for service on an informant or the DPP. This new express service category has been created because the personal and ordinary service provisions are not relevant to service on an informant or the DPP. Under subclause (2), a document may be served on the informant in the following ways—
by giving a copy of the document to the informant, or a person representing the informant, at a hearing in relation to the charge; or
by sending a copy of the document by pre-paid ordinary post addressed to the informant; or
by sending a copy of the document by fax or email addressed to the informant at the fax number or email address nominated by the informant; or
by leaving a copy of the document for the informant at the informant's business address with a person who appears to work there; or
in any other manner agreed between the informant and the party serving the document. This will allow arrangements in individual cases and protocols between agencies to develop.
See also clause 18 which requires an informant to nominate service details on or with the charge sheet. Under subclause (3), documents may be served on the DPP in the following ways—
by giving a copy of the document to a person representing the DPP at a hearing in relation to the charge; or
by leaving a copy of the document at the Office of Public Prosecutions with a person who appears to work there; or
by sending a copy of the document by prepaid ordinary post addressed to the Office of Public Prosecutions at the ordinary business address of the Office of Public Prosecutions; or
by sending a copy of the document by prepaid ordinary post addressed to the DPP at the business address, if any, nominated by the DPP; or
by sending a copy of the document by fax or email addressed to the DPP at the fax number or email address nominated by the DPP; or
in any other manner agreed between the DPP and the party serving the document. This will allow arrangements in individual cases and protocols between agencies to be developed.
