Clause 316

allows the Registrar of Criminal Appeals to require a trial judge to provide a report on a case tried by the judge, giving the opinion of the trial judge on the case or on any point arising in the case. This clause is based on section 573 of the Crimes Act 1958 which also referred to the trial judge's notes of trial. This historical reference is redundant in light of the way in which trial transcripts are kept by the Victorian Government Reporting Service.
