Clause 267

sets out the procedure if an appellant fails to appear at an appeal and permits the County Court to strike out or adjourn the appeal. If an appeal is struck out—
the order of the Magistrates' Court may be enforced as if an appeal had not been made except that time is deemed not to have run during the period of any stay under clause 264; and
the registrar of the County Court must give the respondent a copy of the order striking out the appeal.
The County Court can set aside an order striking out an appeal due to the failure of the appellant to appear if the court is satisfied that the failure to appear did not result from any fault or neglect by the appellant.
