Clause 268

sets out the procedure in cases in which the respondent fails to appear at an appeal by the DPP, in which case the County Court can adjourn the appeal or hear and determine the appeal in the absence of the respondent. However, the County Court cannot impose a sentence that requires the consent of the respondent (such as a community-based order) in the respondent's absence. If the County Court adjourns the proceeding, it may issue a warrant to arrest the respondent.
