Clause 246

requires an accused to attend all hearings conducted under this Chapter in the criminal proceeding, unless excused under clause 330 (the main clause governing the appearance and attendance of accused at hearings). This is a new clause creating an express presumption of attendance (defined in clause 3 to mean physical presence) of the accused at all hearings under this Part. This clause is part of a Bill-wide approach to the issue of when an accused is required to appear or attend.
