Clause 258

sets out how an appeal by the DPP is commenced, namely by filing a notice of appeal, which must comply with the clause and the rules, in the Magistrates' Court within 28 days of sentencing. A copy of the notice of appeal must be served personally on the respondent within 7 days after the day the notice is filed. Service for such appeals is personal because it is a significant new step in a proceeding and the accused may have thought that the matter was finished. Further, the DPP is required to provide a copy of the notice of appeal to the legal practitioner who last represented the respondent, if they can reasonably be identified.
