Clause 265

allows an appellant who is in custody because of the sentence appealed against to apply to the Magistrates' Court for bail and give notice to the respondent. The Magistrates' Court may either grant or refuse bail as if the appellant were an accused applying for bail and the Bail Act 1977 applies.
