gives an express power to the Magistrates' Court to order an informant to disclose any material in accordance with a request by the accused under clause 43 or as required under Division 2, Part 3.2. This power is currently contained in clause 1A(6), Schedule 2 to the Magistrates' Court Act 1989. It has been broadened to cover two situations—
where the informant has refused to disclose information requested by the accused and the accused disputes the reasons given by the informant; or
the informant has failed to comply with their obligations under the Division in any other way.
The accused may apply for such an order if the informant has served on the accused (under clauses 37(1)(f), 41(1)(f) or 45) a statement of grounds for refusing disclosure or if the informant has failed to give disclosure in accordance with the Division.
