Clause 14

provides that a member of the police force or a public official acting in the performance of his or her duty may commence a criminal proceeding (see clause 6(1)(c)) by issuing a summons after signing a charge-sheet containing a charge. If the member of the police force or public official issues the summons, they must file the charge-sheet and summons with the appropriate registrar within 7 days after signing the charge- sheet. If they fail to do so, the Magistrates' Court has discretion to strike out the charge. Clause 349(3) allows costs to be awarded if a proceeding is struck out.
