Clause 41

sets out the contents of a full brief. The purpose of the full brief is to provide more comprehensive disclosure than the preliminary brief. It includes material that is relevant to the charge, both that the prosecution intends to rely on and that it does not intend to rely on at the summary hearing. The clause lists, on an inclusive basis, the type of material that should be included in a full brief. The full brief replaces both the brief provided in accordance with clause 1A, Schedule 2 to the Magistrates' Court Act 1989 and the brief of evidence in section 37 of the Magistrates' Court Act 1989. As a single, comprehensive disclosure process, the full brief avoids the current problems with two different brief processes and the limited disclosure that is in the brief of evidence.
