Clause 353

sets out the requirements of a costs order in cases where the court determines that one should be made under clause 352 or 358. If the court is satisfied that a party or a party's legal practitioner has reasonably incurred additional costs as a result of any act or omission of another party, the order must provide for the payment of costs to the first-mentioned party. In all other cases, the order must provide for payment of costs into court for payment into the Consolidated Fund. Division 4—Costs on appeal
