Clause 21

provides that a member of the police force or a public official acting in the performance of his or her duties may serve a notice to appear if they reasonably suspect that the person has committed a summary offence or an indictable offence that may be heard and determined summarily. A public official is defined in clause 3. The clause also specifies information which the notice to appear must contain, including a brief description of the offence and surrounding circumstances, contact details for the person serving the notice and a date and time when the person served with the notice must attend court. The Bill provides an alternative method of dealing with alleged offenders who are currently brought before the Magistrates' Court by way of summons. The notice to appear is intended to be a simple and more efficient mechanism for use in minor matters. It is available for all summary and indictable offences which may be heard and determined summarily. The notice to appear must be served by giving it to the person, or if the person does not accept the notice, by putting it down in the person's presence and telling them the nature of the document.
