Clause 118

provides that the accused and either the DPP or informant (as applicable), must jointly file a case direction notice with the registrar at least 7 days before the committal mention hearing if a hand-up brief is served. Subclause (2) provides that if the accused is unrepresented and does not sign a case direction notice, the DPP or informant must file the notice despite the accused not having participated in discussions or activities connected with its preparation. Subclause (3) provides that if the court fixes another date for a committal mention hearing, it has a discretion to direct that another case direction notice be jointly filed with the registrar at least 7 days before that date or within any other period. The court may also give any direction that it thinks fit as to the matters with which that case direction notice will deal.
