Clause 55

provides a statutory basis for the contest mention system, which is an established case management process in the Magistrates' Court. The Magistrates' Court has a discretion to conduct a contest mention hearing between the return date and the summary hearing. A contest mention hearing can be held on the application of a party or on the court's own motion in accordance with clause 337.
