This Part provides for the admissibility of evidence relating to conduct, reputation, character and tendency of parties and witnesses, that is relevant to a fact in issue in the proceedings. Clause 97 sets out the "tendency rule" and clause 98 sets out the "coincidence rule". The Part does not apply if a matter is a fact in issue or relates only to the credibility of witnesses. Credibility evidence is dealt with in Part 3.7. Part 3.8 sets out rules relating to evidence of the character of a defendant in a criminal proceeding.
