is designed to align the Bill more closely with the common law test for loss of privilege as set out in Mann v Carnell (1999) 201 CLR 1. This implements recommendation 14-5 of the 2005 LRCs' Report. Section 122 of the UEAs provides that client legal privilege is lost by consent or by knowing and voluntary disclosure of the substance of the evidence. However, this clause provides that evidence may be adduced where a client or party has acted in a manner inconsistent with the maintenance of the privilege.
