provides that, if in a criminal proceeding, having regard to the circumstances in which an admission was made, it would be unfair to an accused to use evidence of the admission in the prosecution case, the court may refuse to admit the admission at all, or admit the admission, but limit its use. The Note to clause 90 makes it clear that the admission may nevertheless be excluded under other relevant discretions (contained in Part 3.11).
