87P Definition

In this Division—
S. 87P substituted by No. 56/2013 s. 32.
serious motor vehicle offence means—
S. 87P def. of serious motor vehicle offence amended by No. 65/2017 s. 18.
(a)manslaughter arising out of the driving of a motor vehicle; or
(b)an offence under section 24 of the Crimes Act 1958 in respect of serious injury arising out of the driving of a motor vehicle; or
(ba)an offence under section 317AC, 317AD, 317AE or 317AF of the Crimes Act 1958 arising out of the driving of a motor vehicle; or
(c)an offence under section 318 of the Crimes Act 1958 arising out of the driving of a motor vehicle (other than the operating of a vessel); or
(d)an offence under section 319 of the Crimes Act 1958 arising out of the driving of a motor vehicle (other than the operating of a vessel); or

(e)murder or attempted murder arising out of the driving of a motor vehicle; or
S. 87P(e) inserted by No. 6/2020 s. 10(b).
(f)any of the following offences, if arising out of the driving of a motor vehicle while under the influence of alcohol or alcohol and a drug—

(i)an offence under section 15A or 15B of the Crimes Act 1958;
(ii)an offence under section 16, 17 or 18 of the Crimes Act 1958;
(iii)an offence under section 22 or 23 of the Crimes Act 1958;
(iv)an offence under section 63A of the Crimes Act 1958;
(v)the common law offence of kidnapping;
(vi)an offence under section 79 of the Crimes Act 1958;
(vii)an offence under section 79A of the Crimes Act 1958.
